Terms of Use and Liability Disclaimer

E-Course Policy 

To access this online E-course, you must attest that you have read and agree to the terms and conditions contained in this E-Course Terms and Conditions Agreement. The term “course” includes the E-course web pages, courses and all associated materials. Registrants are deemed and presumed to be aware of and familiar with this E-Course Terms and Conditions Agreement. If you do not agree to these terms, do not proceed with the use of this E-course.

Anaesthesia Academy UK has sole right and discretion to determine whether to sell our E-course to any individual and may reject a purchase by any individual with or without explanation.

To the extent that any Content is in conflict or inconsistent with this Agreement, this Agreement shall take precedence. Our failure to enforce any provision of this Agreement shall not be deemed a waiver of such provision nor of the right to enforce such provision. Our rights under this Agreement shall survive any termination of this Agreement.

Attestation 

Anaesthesia Academy UK will deny access to this E-course to any individual who does not agree to the terms and conditions contained in this E-Course Terms and Conditions Agreement. Further, Anaesthesia Academy UK reserves the right to terminate access to any individual who does not abide by these terms and conditions.

Refunds  

You may withdraw from this E-course at any time. However, once you are registered and have logged in to the course, you will not receive a refund for any reason. All sales are final for online E-courses. No refunds are issued for online courses once a sale is completed. 

Effective Period 

Registrants can have access to this e-course for one (1) year from the date of purchase.

Complaints about a breach of Terms and Conditions 

Complaints about a breach of these E-Course Terms and Conditions Agreement should be made by e-mail to [email protected]

General Disclaimer and Anaesthesia Academy UK Rights 

The subject of this E-course is complex and evolving. The information in our E-course is by no means complete or exhaustive and therefore is for educational purposes only.   We make no representations, guarantees or warranties that the information in our E-course is appropriate or accurate in every respect or complete, and disclaim responsibility for the use and application of the information.  Anaesthesia Academy UK does not assume responsibility or liability for the accuracy or completeness of content contained in reference materials and does not endorse any product, service or organization referenced. Consult the manufacturer’s instructions for the particular device you are using and the product information sheet for any drug administered. 

By purchasing this E-course, you are assuming the risk that the information and content may not be appropriate for medical practice.

Responsibility for Loss 

You are responsible for and will indemnify and hold Anaesthesia Academy UK harmless from and against any and all liability, claims and losses resulting from your actions in connection with taking this E-courses and your breach of any terms and conditions of this E-Course Terms and Conditions Agreement.

To the fullest extent permitted by applicable law, you agree that neither Anaesthesia Academy UK nor any of the Anaesthesia Academy UK participants will be liable to you for any loss or damages, either actual or consequential, arising out of or relating to these terms of service, or your (or any third party's) use of or inability to use the E-course website, or your placement of content on the E-course website, or your reliance upon information obtained from or through the E-course website, whether your claim is based in contract, tort, statutory or other law.

In particular, to the fullest extent permitted by applicable law, neither Anaesthesia Academy UK nor any of the Anaesthesia Academy UK participants will have any liability for any consequential, indirect, punitive, special, exemplary, or incidental damages, whether foreseeable or unforeseeable and whether or not Anaesthesia Academy UK nor any of the Anaesthesia Academy UK participants has been negligent or otherwise at fault (including, but not limited to, claims for defamation, errors, loss of profits, loss of data, or interruption in availability of data)

The content provided in our e-course is provided “as is,” “as available,” with “all faults”, and all warranties, express or implied, are disclaimed (including but not limited to the disclaimer of any implied warranties of merchantability and fitness for a particular purpose). Our website and content may contain bugs, errors, problems or other limitations. Anaesthesia Academy UK, including all our affiliates, have no liability whatsoever for your use of our website or content. Anaesthesia Academy UK cannot guarantee and does not promise any specific results from use of our website or content.  Anaesthesia Academy UK does not represent or warrant that our content or our services found within are accurate, complete, reliable, current or error-free or that any such items are free of viruses or other harmful components. Therefore, you should exercise caution in the use and downloading of any such content and use industry-recognized software to detect and remove viruses. All responsibility or liability for any damages caused by viruses somehow attributed to our content and services is disclaimed. Without limiting the foregoing, you understand and agree that you download or otherwise obtain content through our website or services at your own risk and that you will be solely responsible for your use thereof and any damages to your mobile device or computer system, loss of data or other harm of any kind that may result.

In no event will Anaesthesia Academy UK  or its corporations, employees, contractors, vendors, affiliates or agents be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages arising from your use or misuse of this content whether such damages arise in contract, tort, negligence, equity, statute or by way of any other legal theory regardless of whether such damages could have been foreseen.   Notwithstanding anything to the contrary contained herein, Anaesthesia Academy UK’s liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to us for the e-courses we provide prior to the event giving rise to liability.

Use of E-Course Materials 

All e-courses and materials, along with references used in or related to the E-courses, are the property of the Anaesthesia Academy UK or of third parties and used under permission granted to the Anaesthesia Academy UK and may only be used in the manner detailed in this E-Course Terms and Conditions Agreement. Permission to use the material in any other way must be obtained in writing from the Anaesthesia Academy UK and/or the publisher or author of the material. These materials are for the sole use of individuals registered for the E-course. As an E-course registrant, you may view and read all materials that are part of the E-course facility. You may also print any or all screen and pdf file pages for your personal use in taking the E-course, but you may not share, communicate, publish or in any manner distribute to other parties the E-course, login and password, readings, references, links or any other materials. The terms and conditions regarding use of materials apply upon registration for the course, while you are taking the E-course, and upon and after completing, withdrawing from or terminating the e-course.

By purchasing this E-course, Anaesthesia Academy UK grants you a nonexclusive, nontransferable, revocable license to access and use our copyrighted E-course and any associated materials solely for your own personal and non-commercial use.  Our E-course is protected under United Kingdom and foreign copyrights. The copying, redistribution, use or publication by you of any of the content within our E-course is strictly prohibited.  Your purchase of our E-course does not grant you any ownership rights to our E-course.  Any breach in the terms of this agreement may result in termination of your access to the E-course materials.

E-Course System Access 

You agree that you will not use any robot, spider or other device, process or means to access this E-course. Nor shall you use any process to monitor or copy our Web pages or the content contained thereon or for any other unauthorized purpose without our prior expressed written permission. You agree that you will not compromise or circumvent the security controls of the E-course or otherwise gain unauthorized access to Anaesthesia Academy UK e-courses. You agree that you will not use any device, software or routine that interferes with the proper working of this E-course nor shall you attempt to interfere with the proper working of the Anaesthesia Academy UK e-courses. You agree that you will not take any action that imposes an unreasonable or disproportionately large load on our infrastructure. You agree that you will not copy, reproduce, alter, modify, create derivative works or publicly display any content from the Anaesthesia Academy UK e-courses without the prior expressed written permission of the Anaesthesia Academy UK.

When you complete the purchase process, you will receive a password that will allow you to access our Content. You agree to maintain the confidentiality of your password and are fully responsible for all liability and damages resulting from your failure to maintain that confidentiality and all activities that occur through the use of your password. You agree to immediately notify us of any authorized use of your password or any other breach of security.

References to third-parties

Our E-course may contain references or links to materials from third-parties.  Reference to any third-party products (such as pumps, I.V sets or other medical devices) processes or other information, by trade name, trademark, manufacturer, supplier or otherwise does not constitute or imply endorsement, sponsorship or recommendation thereof, or any affiliation with us.  We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials, products, or services.  We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-parties. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party. 

Copyright infringement

We will respond quickly to claims of copyright infringement as found in our E-course.  If you believe any copyrights are infringed by our E-course, please provide us with a written notice via email that contains the following information:

(1) An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;

(2) A description of the copyrighted work that you claim has been infringed;

(3) A description of where the material that you claim is infringing is located on our Website;

(4) Your address, telephone number, and email address;

(5) A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and

(6) A statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

We are only required to respond to those notices that substantially comply with the above requirements.  We will investigate your claim and will notify by the method of contact you used to file your notice with us.

Other general terms

This agreement is governed by the laws of the United Kingdom. You hereby consent to the exclusive jurisdiction of the United Kingdom courts in all disputes arising out of or relating to the use of the website. Use of the website is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph.

Any cause of action by you with respect to our Website or Content must be instituted within one (1) year after the cause of action arose or be forever  waived and barred. Should any part of this Agreement be held invalid or unenforceable, that portion shall be construed consistent with applicable law and the remaining portions shall remain in full force and effect.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and Anaesthesia Academy UK as a result of this agreement or use of the E-course. Each and every provision of this agreement is separate and severable. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set out above, then the validity and enforceability of the remainder of the terms and conditions shall not be affected.

This agreement constitutes the entire agreement between you and Anaesthesia Academy UK with respect to the E-course and they supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and Anaesthesia Academy UK with respect to the E-course. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. Any rights not expressly granted herein are reserved. You will be responsible for all charges, fees, duties, taxes, and assessments arising out of the use of the E-course.

Variation of these terms and conditions

Anaesthesia Academy UK reserves the right to change the terms, conditions, and notices under which the Website is offered. We will do this by altering the access agreement on the Website and this alteration will then be of immediate effect. For this reason, you should regularly visit the access agreement on the Website as the current version will be binding on you.
